SmartAqua (“Company”, “We”, “Us”, “Our”) values your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, store, and safeguard your information when you use our services, applications, website, or devices.

1. Information We Collect

  1. Personal Information: Name, mobile number, email address, billing/shipping address, government ID (if required for KYC).
  2. Payment Information: UPI, credit/debit card details, Razorpay mandate/AutoPay authorization details, bank account details for NACH.
  3. Device Information: Unique Device ID, location data during activation, IoT telemetry data (usage, flow sensor, error logs, tamper alerts).
  4. Account Information: Subscription status, recharge history, invoices, service requests, complaints.
  5. App & Website Data: Login credentials, session logs, IP address, cookies, and analytics data.

2. How We Use Your Information

We use your information to:

  1. Provide and manage your subscription service.
  2. Process payments, renewals, AutoPay/NACH mandates, and security deposits.
  3. Deliver, install, and maintain SmartAqua devices.
  4. Detect tampering, unauthorized usage, and fraudulent activity.
  5. Send transactional and service-related notifications (e.g., expiry alerts, renewal reminders, technician updates).
  6. Improve app, website, and customer experience through analytics.
  7. Comply with legal, taxation, and regulatory requirements.
  8. Offer promotions, referral benefits, or loyalty programs (with your consent).

We may share your information only with:

  1. Payment Partners (Razorpay, banks, UPI providers) for billing and AutoPay compliance.
  2. Logistics & Technicians for shipping, delivery, and on-site support.
  3. Regulatory Authorities if mandated by law.
  4. Third-Party Service Providers (cloud hosting, analytics, SMS/email providers) under strict confidentiality agreements.

We do not sell or rent your personal data to advertisers.

4. AutoPay & NACH Authorization

  1. Devices will be shipped to your registered address within 7–15 business days after payment verification.
  2. Delivery delays due to natural calamities, strikes, or logistics partner issues are beyond our control.
  3. Ownership of the purifier remains with SmartAqua. You are only a subscriber.

6. Cancellations & Refunds

  1. Subscription Fees: Non-refundable once billed.
  2. Security Deposit: Refundable within 7 working days after device return in good condition.
  3. Cancellation: You can cancel anytime via app or customer care. Device must be returned to avoid penalties.
  4. Tampered/Damaged Device: Refund forfeited and additional charges may apply.

7. Data Retention

  1. We retain your data as long as you hold an active account.
  2. Post account closure, essential data (billing, tax compliance, disputes) may be retained for 7 years.
  3. IoT telemetry and analytics data may be anonymized for research and product improvement.

8. Data Security

  1. All communication is secured via SSL/TLS encryption.
  2. Sensitive data is stored in encrypted format (AES-256).
  3. Multi-factor authentication (OTP, device binding) is enforced for account access.
  4. We conduct regular security audits to prevent breaches.

9. User Rights

As per Indian IT Act & Digital Personal Data Protection Act, 2023 (DPDP Act), you have the right to:

  1. Access your personal data.
  2. Request correction of inaccurate details.
  3. Withdraw consent (may affect service continuation).
  4. Request data deletion (subject to regulatory requirements).

10. Cookies & Tracking

  1. We use cookies and similar technologies for session management, fraud prevention, and analytics.
  2. You may disable cookies via browser settings, but some app/website features may not function properly.

11. Marketing & Communication

  2. You can opt out anytime from promotional communication, but transactional alerts (renewals, payments, expiry) cannot be disabled.
